How Influenced Is The Florida’s Real Estate System?

Florida’s real estate system is often presented as consumer-focused and transparent. However, a closer look raises serious questions about whose interests the system truly serves.

Did you know that:

  • Around 80% of Florida lawmakers have received endorsements from the Florida Realtors® Political Action Committee (PAC), the most powerful lobbying organization in the state’s real estate industry.

  • Under current Florida law, most real estate brokerages do not represent buyers or sellers in a fiduciary capacity by default, and they are not required to clearly disclose this presumption to consumers at the outset of a transaction.

  • The law also does not require disclosure of the financial advantages that the transaction-broker model provides to brokerages, including the ability to benefit from both sides of a transaction.

  • As of 2024 fifteen sitting Florida lawmakers are actively involved in the real estate industry, yet none have demonstrated meaningful interest in reforming the system that governs their own profession.

Florida Realtors® openly acknowledge their legislative presence through an organized Realtor Caucus. As stated by the organization’s 2024 President:

“Our Realtor Caucus continues to grow each year as more of our members recognize the importance of having a Realtor voice in the room when critical decisions are being made about our industry and our ability to make a living. Tallahassee can be very unpredictable during the legislative session, but knowing we have 15 lawmakers who walk in our shoes every day and are looking out for our interests should give us all reassurance that the Realtor profession is in good hands in Florida.”

This statement confirms what many buyers and sellers are never told: the system is actively shaped by those who benefit from it.

The result is a structure where:

  • Consumers often believe they are being represented when they are not,

  • Buyers may believe they are “saving” commissions when compensation is simply redirected, and

  • Meaningful reform faces institutional resistance.
